Superior Court, Hampden County, Massachusets, verdict returned March 2017. The defendant failed to pay our client sums due under their written contract so we sued for breach of contract.  The defendant denied the material allegations of the complaint and alleged counterclaims for fraud, misrepresentation, and deceptive and unfair trade practices.  After a jury trial was held, the court first directed a verdict in favor of our client on all of the defendant’s counterclaims.  After considering our client’s remaining breach of contract claim, the jury quickly returned a verdict in favor of our client for $65,731.51, the exact figure that we requested during trial.  The court’s final judgment is forthcoming.

County Court, Orange County, Florida, filed October 19, 2016.  The defendant failed to pay our client sums due under their contract, so we filed suit for breach of contract to collect the unpaid sums. The defendant then failed to respond to the complaint and a clerk’s default was entered in Februrary 2017, followed by entry of final judgment in favor of our client for the full amount due.

 

District Court, Tarrant County, Texas, Judgment entered November 2015.  Our client sued for breach of contract, conversion, and to enforce non-compete and non-solicitation covenants of the parties’ contract.  We first won an early motion for temporary restraining order and temporary injunction, then obtained summary judgment on defendants’ counterclaim for breach of contract.  After a bench trial, we obtained a money judgment against defendants in the amount of $163,279.08 plus an award of attorney’s fees in the amount of $24,054.44 for a total money judgment of $187,333.52.  Additionally the court entered an injunction enforcing the non-compete and non-solicitation covenants of the parties’ contract.

Superior Court, Muscogee County, Georgia, filed 2012.  We filed a breach of contract action seeking to enforce non-compete and non-solicitation covenants and a count for replevin seeking return of machinery.  Obtained summary judgment on opponent’s counterclaim for $156,000, who then filed for bankruptcy protection, ending the case.

County Court, Orange County, Florida, filed 2012.  Filed suit for breach of contract and replevin, seeking return of machinery.  After litigation, obtained default judgment ordering return of machinery and awarding money damages for breach of contract.

Court of Common Pleas, South Carolina, filed 2012.  Sued for breach of contract, replevin, and enforcement of non-compete and non-solicitation covenants.  Obtained summary judgment on the replevin count, which awarded possession of the machinery.  After a bench trial, our client obtained a judgment enforcing non-compete and non-solicitation covenants, and awarding client money damages for breach of contract.

Superior Count, Bartow County, Georgia, filed 2012. Sued for breach of contract, misappropriation of trade secrets and unfair competition.  After litigation, obtained a settlement favorable to client that included non-compete and non-solicitation covenants.

U.S. District Court, Northern District of Georgia, filed 2012.  Sued for trademark infringement and unfair competition.  After litigation, obtained a settlement favorable to client that included non-compete and non-solicitation covenants.

County Court, Orange County, Florida, filed 2012.  Sued for breach of contract and conversion.  After litigation, obtained a default judgment for possession of machinery and money damages for breach of contract.

U.S District Court, Eastern District of Virginia, filed 2011.  Sued for breach of contract and breach of non-compete and non-solicitation agreements.  After litigation obtained judgment awarding money damages for breach of contract and enforcing non-compete and non-solicitation agreements.

Circuit Court, Chesterfield County, Virginia, filed 2011.  Sued for breach of contract, civil conspiracy, tortious interference with contract, and theft of trade secrets.  After litigation, obtained a settlement agreement favorable to client consisting of money damages and agreements to cease operating competing business and cease soliciting customers.

U.S. District Court, Eastern District of Wisconsin, filed 2011.  Sued for breach of contract and to enforce non-compete and non-solicitation agreements. After litigation, obtained a default judgment enforcing the restrictive covenants and awarding client money damages.

Superior Court, Rockdale County, Georgia, filed 2011.  Filed suit for breach of contract and replevin, seeking return of machinery and money damages.  After trial, jury returned verdict in favor of client for return of machines and money damages.

Circuit Court, Orange County, Florida filed 2010.  Sued for breach of contract and replevin, seeking return of machinery.  After litigation, received return of machinery pursuant to summary judgment on replevin count and then obtained a settlement favorable to client.

Superior Court of Connecticut, Litchfield, filed 2010: Sued for theft of trade secrets, deceptive and unfair trade practices and breach of non-compete covenants.  After litigation, obtained a settlement favorable to client.

Court of Common Pleas, Montgomery County, Ohio, filed 2010: Sued for breach of contract, breach of non-compete covenant, breach of non-solicitation covenant, and replevin for return of machinery.  After litigation, obtained a settlement favorable to client enforcing non-compete covenant and breach of non-solicitation covenant, and return of machinery.

Circuit Court, St. Charles County, Missouri, filed 2009.  Sued for breach of contract and to enforce non-compete and non-solicitation covenants.  Defendants filed counterclaim alleging fraud.  Obtained summary judgment on defendant’s counterclaim, and after trial, obtained judgment for preliminary and permanent injunctions enforcing non-compete covenant and non-solicitation covenants and money damages for breach of contract.

Circuit Court, Orange County, Florida, filed 2009.  Client was sued for breach of contract and fraud. We answered and filed a counterclaim for breach of contract.  After litigation, obtained a settlement agreement favorable to client.
